ZAHOOR AHMAD versus STATE
Criminal Code of Conduct (CR PC) Sections 497 and 498 of the Criminal Code (XLV of 1860), Sections 337A (i), 337A (ii), 337F (i), 354, 452, 148 and 149 pre-arrest bail. At the discretion of the High Court, the accused was given safe bail by the High Court and was directed to refer to the competent court for bail, instead of returning to the competent court as directed by the High Court, he was arrested again before the High Court. The bail was filed and the fact was suppressed earlier. Effect of exercise of powers under section 498 of the petition, CCP read with clause 497, CCP was arbitrary in the role where the accused had concealed material facts from the High Court, denying such arbitrary exercise. No other matter was considered by the High Court and the bail was denied accordingly.
