The appearance and absence of parties to the Civil Procedure Code Order IX of CPC resulted in the refusal to exclude O IX, R 6. The High Court did not list the cause of the High Court before the plaintiff's counsel, nor did the case number mention the excuse as to the absence of any other court's counsel to engage.
