GUL MUHAMMAD versus THE STATE
Sections 439 and 561 of the Code of Criminal Procedure (CR PC) A review was filed by the parties under Section 5540, CR PC under the jurisdiction of the High Court, and it was dismissed by the trial court, The complainant was not enforced. The amendment was allowed and the same was challenged on the basis of fraud and misrepresentation which opposed the application under section 5540, CRPC was not made a party to the High Court effect order in the trial court. Which was passed without the complainant's hearing. A serious prejudice complaint / complainant's request was allowed by the High Court and in exercise of the powers under section 6161 AA, the order passed before the CCPC was revoked accordingly. ?
