MUHAMMAD ASLAM versus RAZIA BEGUM
Article 120 Civil Procedure Code (v. 1908), the section 115 revision document executed by an uneducated gifted dead man, the subject of a civil suit, was executed by an uneducated man. The sub-registrar who was said to have gone to the executioner's house for registration purposes and other persons present at the time of execution, challenged the gift case by the plaintiff / applicant. The case was not submitted before the court suit which was dismissed by the trial court which was proved by the appellate court at trial. All errors and serious reflections on the defendants / defendants case were not legally considered by both courts and their decisions were the result. The evidence was misunderstood and misread, and the decisions of both the courts were set aside and the circumstances allowed.
