FAZAL MUHAMMAD versus THE STATE
Complaint filed by the Magistrate Validity Government Employee on trial of the Pakistan Penal Code Section 188 Criminal Code (V9 1898), Section 195 (l) (a) Constitution of Pakistan (1973), Article 199 Constitution. According to the relevant law, the provisions of section 195 (1) (a) were the CCP Assistant Commissioner who passed the order under Section 144, CRPC and the Deputy Commissioner, who was under the magistrate's complaint, Had no legal authority because he was not. Neither the public servant nor the Assistant Commissioner was better off. The proceedings of the Assistant Commissioner, pending against the accused under 5188, were dismissed in the magistrate's court, invalidating the court's proceedings and accordingly the constitutional petition was rejected.
