Constitution of Pakistan 1973 Arts 63A and 185 Provincial Assembly members have been disqualified on the basis of disqualification as appealed to the Supreme Court in Article 63A of the Constitution. The Supreme Court remanded the case with observations. The Supreme Court's decision in the matter of advocate Mahaj-Barai was not rendered in the Gift of Constitution vs. Federation of Pakistan (PLD 1998 SC 1263) when the matter was heard by the Chief Election Commissioner who concluded it. It was held that the member was disqualified for consideration under Article 63A (1) and the Chief. The Election Commissioner had no interest in examining the reasoning of the aforementioned verdict; the Supreme Court remanded the Chief Election Commissioner on the basis of the material raised in the light of the apex court's decision.
