MUHAMMAD AYUB versus ADMINISTRATOR, MUNICIPAL COMMITTEE, GUJAR KHAN
Government Employees (Talent and Discipline) Rules 1973 R 13 Constitution of Pakistan (1973), Article 185 (3) Municipal Committee Employees Misconduct Resignation / Removal From the Office of the High Court on the basis of record-based evidence. Ordered the rehabilitation of such employees. (Respondents) sought relief against the Municipal Committee and not against the petitioner, the High Court had approved against the Municipal Committee after the satisfaction that the respondent (employees) was not subject to mismanagement in question. Therefore, it can no longer be heard. Relief was sought against it because of the applicant's complaint that it would be likely to be burdened with a potentially invalid order. The applicant would be entitled to it and when such evidence proved that he had never received the money from the respondent, therefore, in any case the appeal to the Supreme Court for interference was not allowed.
