Vacancies and Displaced Persons Act (repealed) Act 1975 Section 3 (2) Settlement Scheme (Revised) No. VI, II, paragraphs 3 and 3 (a) Civil Procedure Code (v. 1908), and XLIII , R1 Constitution of Pakistan (1973), Article 185 (3), the leave of appeal for cancellation of industrial concern was granted to consider the concessions which the High Court mistakenly considered that the applicants. Did not comply with the directions of the High Court and appealed under OXLIII; R1 dismissed; that the Senior Member Board of Revenue had no intention of canceling the auction and only paying for the arrears. The toss was issued which was paid prior to such cancellation and thus the Board of Revenue could not cancel the auction and the senior member, to cancel the auction, had to comply with the aforesaid Act of the Board of Revenue (XIV of 1975). There was no jurisdiction under section 3 (2), or paragraphs 3 and 3 (a) of the Settlement Scheme (Amended) No. VIII, and if relevant law provisions were pressed, the applicant Was entitled to apply and pay the balance amount within 30 days of cancellation, and because the amount was already paid or the request was not canceled
