Civil Servants Act 1973 Section 17 Constitution of Pakistan (1973), Article 212 (3) provides for four advancement increments for former employees to get a M.Phil degree for increasing employment in the previous assignment and two advance increments based on his past. Was allowed Experienced civil servant, then, joined the Department of Education in which he was allowed four increments for his M.Phil degree but was denied the benefit of two advance increments for past experience as a civil servant. Could not identify any legal code or direction under which he could make two claims. Due to his past experience, Advance Increments was, at the discretion of the respondents, in the absence of any rules or guidelines that would allow such advance increments. Factum that a government employee had applied through the appropriate channel with no post office attachment. With this question, was the civil servant entitled to take two advance increments based on his previous experience? The latest employment in the various Establishments of Government employees will entitle them to claim salaries and other benefits which were attached to such a post. Appeal leave was denied in the circumstances.
