Section 5 Constitution of Pakistan (1973), Arts 199 and 212 Appointments were made in the press release of the post holding the constitutional petition, inviting applications and the interview was to be made on the dates stated in the advertisement whose appointment was made on the same day. The advertisement on the request of potential candidates was made on the record shows that a person was appointed on the basis of the recommendations of the minister. Such appointment was considered to be illegal, for the law to be unprofitable. For this reason, under Article 199 of the Constitution, the constitutional right was without jurisdiction over the High. A court was upheld against such an appointment and the bar contained in Article 212 of the Constitution was not attracted.
