The leave to appeal the NWFP Engineering Service (Building and Road Department, Irrigation Department and Public Health Engineering Department) Rules 1973 R3 Constitution of Pakistan (1973), Article 212 (3) was granted against the order of the service tribunal on this basis. It was noted that in the NWFP Engineering Service (Building and Road Department, Irrigation Department and Public Health Engineering Department) rolls, in 1973, two separate cadre were considered. A general cadre consisting of Chief Engineers, Superintendent Engineers, Executive Engineers as mentioned in Schedule I and other sub-cadre specials. Posts like Principal Engineers, Project Managers and Senior Engineers under Schedule 11 and that the respondents belong to separate cadres, and hence the names of the respondents could not be included in the applicant's cadre's list of cadres.
