A public servant will withdraw from the appropriate forum to approach the High Court for resolution of his complaint on the basis of Article 212 of the Constitution and to take practical action for his alleged wrongful or unlawful termination / removal and the Service Tribunal had issue. Or the dispute did not fall within the scope of fitness or another applicant to occupy a specific position but is subject to the terms and conditions of service
