The Rule for Civil Procedure 1908 Section 11, IV Constitutional Stability Justice, Object Theory and Objective Constructive Resistance If the parties have had the opportunity to emphasize all grounds in support of their claim or defense in their previous case. And if they have not done so, they will be deemed to have raised such grounds in the previous case and it will be deemed that those grounds have been heard and decided as if such matters would in fact be dismissed by such parties. Extending those grounds in the latter case will force such cases to become a judiciary again, based on legal fiction.
