NOOR MUHAMMAD versus SECRETARY TO THE GOVERNMENT OF PAKISTAN, MINORITIES AFFAIRS DIVISION, ISLAMABAD

Under the AQQ Trust Properties (Management and Disposal) Act 1975 Section 21 Constitution of Pakistan (1973), Article 199 Constitutional Appeal was pending before the Chairman of the proceedings relating to the estate of the estate, of which the informant was one of the defendants. She died during the proceedings and her inheritance was not allowed to be imposed in such proceedings as the defendant's amending authority, however, allowed the late woman's legacy to be enforced in the proceedings. In practice, any of its heirs needs to be implemented. Such a view was clearly wrong and there was no lasting law for the rights of the deceased, if any, in the case of property, would result in his death. Heritage will be accepted. Submission instead of revision - does not defeat the purpose of justice, especially when the matter was decided by the competent authority as the ordinance in question shows that the revision was not forbidden over time. Nor was there any such objection raised before the amending authority; the fact that the deceased defendant's heirs were allowed to be heard before a verdict cannot be considered defeat. Applicants have a legal right to seek intervention by the High Court; their constitutional jurisdiction did not maintain the constitutional petition.
