The appointment of the Chief Justice of the Constitution of Pakistan 1973 Arts 104, 101 (5) and 102 as Acting Governor, does not leave the post of Chief Justice in the event of his appointment as Governor. He did not enter the office legally because he had taken the oath before the acting governor, nor did he have the presence of the governor to appoint and take the oath of office before the removal of the chief justice. The arrangement to prevent the appointment was reached by the Governor, and the Chief Justice ceased to assume the office of acting Governor automatically.
