HUMAYUN IQBAL SHAMI versus PRIME MINISTER OF PAKISTAN
Government Employees (Talent and Discipline) Rules 1973 R4 Constitution of Pakistan (1973), Article 212 (3) against a civil servant was found to be a misdemeanor and he was persuaded by the Censor of Service Tribunal to appeal against the dismissal of a civil servant. Based on the documents presented in the court of exclusion, civil servants claimed litigation that the relevant authority had been dismissed at the relevant time by the relevant authority, therefore, a new investigation based on the same allegation was launched. The competent authority cannot be delegated by civil. The servant also claimed that none of the witnesses examined by the inquiry officer uttered a word in support of the allegations of corruption, and therefore, no specific allegation could be made against him.
