A tenant under Sindh's rent law was ordered out by the rent courts because the landlord needed the premises personally and rent was not paid on time. The tenant went to the Supreme Court. The Court explained a difference every tenant should know. A default is "willful" only when rent is deliberately withheld. A small delay from a bank error, or rent honestly paid or deposited in the wrong place by mistake, is only a technical default, and a tenant should not lose the home for it. But paying on time is still a legal duty, and weak excuses do not help. If the landlord swears he received no rent, the tenant must prove payment with receipts, bank records or postal proof. Here the eviction was upheld. Lesson: pay by traceable means and keep every receipt.
