KHUDA BAKHSH versus STATE
Constitution Pakistan (1973), Article 185 (3) was charged with setting up proceedings before the trial court, before the special court in a civil court affirming the fact or the receipt by which it was issued. Was accused of being a criminal, until he demanded that criminal proceedings be stopped. The reason for which the complainant relied on the Supreme Court is that the trial court itself is capable of comparing the signatures on the receipt of the accused's signature or sending it for expert opinion and considering the truth of the document. That the trial court determine the accused's guilt or innocence on the acumen and documentary evidence presented to him, otherwise the civil court's decision is capable of a criminal proceeding to establish the fact of fact. Can't accept. At which he was presented to the courts below, thus, the defendant had the right not to stop the criminal proceedings on appeal was denied ccordingly
