EHSANULLAH TARAR versus GUL NAWAZ WARAICH
The case for termination of the Criminal Code of Conduct (CR PC) Section 561A Penal Code (XLV of 1860), section 302/148/149/109 was transferred from the Sessions Court to the Special Court. Following the repeal of the Trial Act, 1992 and the said Act, the trial session was moved under the canceled ordinance: it could not be transferred to another court by the sessions court order of the sessions court. The special court constituted under the Terrorist Activities Pressure (Special Courts) Act, 1975, was declared scheduled for the crime which resulted in the case being heard before the sessions court.
