DEWAN ALI KHAN versus JEHANDAD KHAN
Limitations Act 1908 Article 144 Defendants related to the occupied possession were entered as tenants in the Revenue Record as only one of the nephews was listed as the tenant in the possession of the plaintiff but this entry was written after the words Such entry is possible so it cannot be relied upon, as it contradicts the first part of the admission and the other revenue related to it is recorded by the plaintiff himself in his evidence before the court that he had initially admitted. He voluntarily entered the land as a tenant, but later made a purchase. The plaintiff failed to prove the plaintiff's oral transaction through oral transaction; the title of the defendant could not be deductible to the plaintiffs (owners) since they were initially tenants.
