The Sindh Rated Premises Ordinance 1979 Section 21 Civil Procedure Code (v. 1908), OXLI, R 19, was a gross negligence to restore an appeal dismissed for illegal prosecution. Notwithstanding the fact that he had made the recommendations for his representation, he himself would have to follow through with the diligence of the case, which was also the explanation given by the appellant in the petition for support and the restoration of the affidavit. The grounds for applying for maintenance were insufficient. However, there will be no impediment to the court in restoring the appeal to its original place, as the court would be in favor of settling the case on the merits, rather than on technical grounds, so the appeal would have to be subject to payment of substantial costs.
