The appearance and absence of the CPC of the Civil Procedure Code Order IX resulted in alleged fraud and misrepresentation of the OI, R 13 and Section 12 (2) Constitution of Pakistan (1973), Article 185 (3) ex parte decree. After obtaining from the High Court, setting aside the ex-parte decree and ordering the Danio trial, foreign women had to take special care to inform them of the case but their close relatives were present. No attempt was made to present the defendants (women) personally; the proper procedure was not followed in the service of the summons. Declared deposed former with justification given partial order against women (defendants) and ordered a trial de novo
