ALLAH DITTA versus ZAHOOR AHMED
Civil Procedure Code Order XVII OXVII of the CPC Adjustments, after settling R3 cases, adjourned the case for the evidence of the plaintiffs, but the defendants had numerous motions, some of which, without real justification, to include the evidence. In the failed case, some of the delays were subject to payment of costs and some were considered a final opportunity, but in view of the delayed tactics of the plaintiffs, the court was unable to produce evidence and prove their claims. Excluded for invalid. Plaintiffs on Plaintiffs failed to add evidence to prove their case, despite considerable time and opportunity, their evidence was rightly closed and their jurisdiction overturned by the Court in the absence of any evidence. Rightly dismissed who had so many options to effectively enforce judicial discipline for arrest, the suit further delayed.
