FAZLI RABBI versus THE STATE
The testimony of the Pakistan Penal Code Sections 302, 300, Exceptions 4 and 304, Part I, cannot be termed as sudden, because after the repetition that occurred 3/4 days before the incident, the accused did not even have a view of the prosecution. The witness had no deadly weapon. On the other hand, the accused was armed with dangerous weapons which he used to be exploited illegally and he acted in a cruel and unusual manner when the accused had earlier called the prosecution. Proved to be a planned attack while the accused failed to establish it. The components of the exception to section 300, because of the PPC that they were accused of, cannot claim the benefits of section 300, exception 4, PPC.
