JANA BAI versus GULSHAN
Sindh Rented Premises Ordinance 1979 Sections 15 (2) (vii) and 21 (1) of the Constitution of Pakistan (1973), Article 185 (3) Order to revoke an appeal on remand of tenants by the rent controller approved by the hirer. The High Court submitted the personal requirement of the respondents / landlords on the basis that there was a dispute between the respondents' claims and evidence, the court felt the need for a suitable opportunity for the respondents. Granted, applicants have their permission, with permission to edit the request. The challenge to the remand of the High Court was that the remand was not valid under the CPC and the permission to amend the petition was also against the provisions of the CPC and on the merit, unquestionable rulers had taken the stand that the petitioner should be dismissed. Putting aside the order was permissible based on an invalid order. Remand order, with permission to edit requests, will also have a clearly fair view, requesting leave for dismissal appeal
