BEHRAM HUSSAIN versus ABDUL RASHID SHAH
Sections 11 and 115 of the Constitution of Pakistan (1973), Arts 199 and 185 (3) under the Judicial Settlement Act failed to take place in the common jurisdiction of the applicant civil court which the High Court had earlier passed in its Constitution. The jurisdiction was decided. The High Court, in its constitutional jurisdiction, concluded that the matter was stayed before the civil court by the judiciary, the leave to appeal against the High Court order was dismissed.
