MUHAMMAD ASLAM AND ANOTHER versus STATE
Before the arrest of Article 498 Constitution Pakistan (1973), Article 185 (3), denial of the accused was directly designated in the FIR, in which two women, along with activists operating on SOTA, followed the girl. The accused was charged with injuring. Despite the delay in filing the case and the FIR, according to the High Court's observation, there was no economic factor on the arbitrary issue recorded by the High Court in the pre-arrest bail, no illegality of any kind. There was no movement or discretion. There was good scope for interference by the High Court in the exercise of arbitration, under which the petition was dismissed and refused to appeal.
