MUHAMMAD ZAHOOR CHOHAN versus SYED FARUKH ALI SHAH
The banking court accepted the application under section 19 of the Criminal Code (v. 1898), section 5540 of the Constitution of Pakistan (1973), Article 199 of the Complaints (Loans, Progress, Credit and Financial Affairs) Act 1997 under section 19 of the Banking Companies. To ask for a witness filed by the complainant, whose name was not mentioned in the complaint or the list of witnesses attached to it, there was no such witness at the time of filing the complaint, dispute between the parties. Evidence of such testimony was necessary to make the banking court approve an unreasonable order pursuant to section 404040, the provisions of CRPC Keeping dnzr, which were fully applicable was substantial justice between the parties, the High Court has refused to order a woman to work in favor of the applicant and delete arbitrary petition.
