MEHRA (MEHR MUHAMMAD) versus MUHAMMAD YOUNUS
O XLI, Aug. 23, 27, and additional evidence of the repeal of Article 115 Constitution of Pakistan (1973), Article 185 (3), constituted the amending jurisdiction of the High Court for the second time by the Appellate Court setting aside the remand order. The decision in favor of the defendants in the post-remand proceedings was again remanded to the trial court after hearing that the applicants were provided with the opportunity to present additional evidence in the rejection, revised under section 115. A remand order was issued in front of the High Court in the jurisdiction, CPC and the same was directed by the appellate court to decide the appeal according to the law after the parties had the opportunity of hearing. Has been practicing litigation for a long time and has twice raised her legal status to the High Court level. Had brought The Supreme Court did not consider that it was appropriate to put the matter on remand for further trial and upheld the High Court's decision and appealed to the Court of Appeal to resolve the appeal as per law.
