JAMIL AHMED versus KARACHI BUILDING CONTROL AUTHORITY
Karachi Buildings and Town Planning Regulation 1979 Regulation 13 (3) Approval of the application / plan for the permission to perform the works of the building is considered if the building is allowed to perform the work within sixty days from its receipt. If no order was granted on the application, it should be considered approved, subject to the qualification which stated that the application / plan should not violate the provisions of the Regulation, Master Plan or Site Development Plan. Should the master plan not only fix the construction of residential apartments on the underground plot, but the owner also violates the master plan. By the way, shops were constructed, such a revised project could not be considered as an approval of the provisions of Regulation 13 (3) of the Karachi Building and Town Planning Regulations 1979 when the builder could propose a change in his plan and such situation. Do not extend to the law where the law has been violated and the builder was only trying to put on a legal wrap.
