The petition was filed like this but the trial court did not grant permission and the case of the plaintiff was dismissed. The lower appellate court allowed the appeal and decision, and the lower appellate court's order was upheld by the High Court, not to mention the proper name as being a mistake or omission, as well as a duplicate version of a party. Such an error was always subjected to correction which could be made only by seeking the provisions contained in CPC 5 in 153.
