MUHAMMAD AKHTAR HUSSAIN versus STATE
Criminal Code of Criminal Procedure (CRPC) Sections 498 (1d, v. 1860), Sections 302 and 34, which deal with the legacies of the deceased, produced by the pre-arrest defendants, were allegedly equipped with pistols. One of the complainant's sons was shot and killed by the accused during the incident in the last hours of the night and the complainant's daughter was forcibly taken away. The family had acted harshly and the accused was boldly declared guilty and frustrated and influential people who complained. None of the plaintiff's legal heirs personally appeared before the trial court to confirm that there was a genuine compromise where the agreement was in fact suspected and the defendants guilty. The court was of the view that the accused had no case for bail before the arrest and the trial court had not dealt with the matter nor had any good land or any controlling situation. Under the High Court bail, the accused should be granted pre-arrest bail.
