AZIM KHAN versus GOVERNMENT OF N.-W.F.P.
Special Relief Act 1877 Section 42 Constitution of Pakistan (1973), Article 185 (3) for the declaration of proprietary title suit and affirmation of the property belonging to the land which was declared by the provincial government as state property by notification. The cancellation of the notification under which the landowner was declared a State Property Suit was ruled by the trial court but was dismissed on appeal. In review, the High Court upheld the trial court's finding on the important issue of the appellate court affirming. Because the judgment in question, the basis on the property and the appropriate substance on record was based on its judgment and it was properly judged, the High Court had the right not to interfere in the search of the material question. ?
