MUHAMMAD ARSHAD versus PERVEZ
Sections 302, 392 and 435 of the Constitution of Pakistan (1973), Article 185 (3) extrajudicial conviction on the grounds that the accused allegedly had difficulty in position to assist an alien about six weeks after the presence of an alien. Was questioned. The recovery was dubious and the final evidence was unsatisfactory. The High Court, therefore, was justified in not relying on such evidence and justified the acquittal of the accused. The leave of appeal was denied in the circumstances.
